General Terms and Conditions Hout-doe, sustainable wooden toys webshop

Article 1. Applicability 1.1 These General Terms and Conditions of Sale (hereinafter: Terms and Conditions) apply to all offers, orders, and agreements in our webshop, to the exclusion of any other general terms and conditions.

These terms and conditions do not apply to purchases made outside of this webshop, including purchases in our physical stores. The rules of the Civil Code apply in those stores, and "distance purchasing" does not apply.

1.2 Placing an order constitutes acceptance of the applicability of these Terms and Conditions.

1.3 Deviations from the provisions of these Terms and Conditions are only permitted in writing, in which case the remaining provisions remain in full force and effect.

1.4 All rights and claims stipulated in these Terms and Conditions and in any subsequent agreements for the benefit of our webshop are also stipulated for the benefit of intermediaries and other third parties engaged by our webshop.

Article 2. Offers/Agreements

2.1 Our webshop expressly reserves the right to change prices.

2.2 An agreement is only concluded after our webshop accepts your order.

Article 3. Prices and Payments

3.1 The prices stated for the products and services offered are in euros, including VAT and excluding handling and shipping costs.

3.2 Delivery of the goods will take place after payment of the full invoice amount to the account number stated during the ordering process.

3.3 If the prices for the products and services offered increase in the period between placing the order and its fulfillment, you may cancel the order.

Article 4. Delivery

4.1 The delivery times stated by our webshop are indicative only. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order, unless the delivery period is exceeded to such an extent that you cannot reasonably be expected to maintain the agreement. In that case, you may cancel the order.

Article 5. Retention of Title

5.1 Ownership of delivered products will only be transferred once you have paid all amounts owed to our webshop. The risk associated with the products passes to you at the time of delivery.

Article 6. Complaints and Liability

6.1 Upon receipt, you are obligated to check whether the delivered goods comply with the agreement. If not, you must notify our webshop within 7 days.

6.2 If it is demonstrated that the products do not comply with the agreement, our webshop has the option to replace the returned products with new products, repair them, or refund the invoice value.

6.3 If you do not wish to purchase a product for any reason, you have the right to return the product to our webshop within fourteen (14) business days of delivery. Returns are accepted if the product is unused, the packaging is undamaged, and any plastic seal on the packaging is intact. You are responsible for the cost of return shipping. Any costs incurred for previous shipping will not be reimbursed.

Article 7. Orders/Communication

7.1 Our webshop is not liable for any misunderstandings, mutilations, delays, or improper transmission of orders and communications resulting from the use of the internet or any other means of communication between you and our webshop, or between our webshop and third parties, insofar as this relates to the relationship between you and our webshop, unless there is intent or gross negligence on the part of our webshop.

Article 8. Force Majeure

8.1 Without prejudice to its other rights, in the event of force majeure, our webshop has the right, at its discretion, to suspend the execution of your order or to terminate the agreement without judicial intervention, by notifying you in writing, and without our webshop being liable for any damages, unless this would be unacceptable under the given circumstances according to standards of reasonableness and fairness.

8.2 Force majeure means any shortcoming that cannot be attributed to our webshop, because it is not its fault and is not its responsibility under the law, legal act, or prevailing opinions.

Article 9. Miscellaneous

9.1 If you provide our webshop with an address in writing, our webshop is entitled to ship all orders to that address, unless you provide us with a different address in writing to which your orders should be sent.
